Terms of Service

1. Agreement and operator

These Terms of Service govern your access to Financial Portfolio Manager, operated by SWB Technologies, a California sole proprietorship (“we,” “us,” or “our”). By creating an account, starting a trial, purchasing a subscription, or using the service, you agree to these Terms and the policies linked from them.

You must be at least 18 years old and able to enter a binding contract. If you use the service for a business or another person, you represent that you have authority to enter and manage the information you submit.

2. The service

Financial Portfolio Manager is a self-service software tool for organizing households, individuals, financial portfolios, investments, and related reference information. Features and limits depend on the selected plan. Business is one account that may manage unlimited households; it does not include seats, invitations, roles, separate team-member identities, or SWB Technologies managing portfolios on a customer’s behalf.

Subscriptions are offered only to customers located in the 50 United States or District of Columbia for use there. The public website may be viewed from other locations, but website accessibility does not constitute an offer to provide a trial or subscription outside the launch area. We do not use IP-address geoblocking. Customers must accurately confirm U.S. eligibility before Checkout. The service, customer support, and governing documents are offered only in English.

The service may change as we improve it. We will not materially reduce a paid plan’s core functionality during a current paid period without reasonable notice unless a change is required for security, law, provider availability, or to prevent harm.

3. Accounts and security

  • Provide accurate account information and keep it current.
  • Keep credentials confidential and use reasonable safeguards for devices and email accounts.
  • You are responsible for activity performed through your account. Business activity cannot be attributed to separate people when credentials are shared.
  • Notify support@financialportfoliomanager.com promptly if you suspect unauthorized access.

4. Trial, subscription, and billing

A new eligible U.S. customer may receive one 10-day free trial. A payment card and affirmative acceptance of the automatic-renewal terms are required. The plan active when the trial ends becomes the first paid plan and is charged in U.S. dollars at its disclosed monthly price. The subscription then renews monthly until canceled. Annual billing is not offered.

Stripe processes payments. SWB Technologies does not receive or store full payment-card details. Subscription charges ordinarily appear as FIN PORTFOLIO MANAGER on your payment statement. Upgrades take effect immediately with Stripe proration. Downgrades take effect at the next renewal after any required data-retention choices are complete. A returning customer is not eligible for another trial. Taxes may be added when required by law.

5. Cancellation, refunds, and account deletion

You may cancel online through account billing settings. Cancellation takes effect at the end of the current trial or paid billing period, and access continues until then. You will not be charged for a later period. Payments are ordinarily non-refundable; duplicate and erroneous charges are corrected, and SWB Technologies may approve an exceptional refund for a severe service-caused incident with substantial customer impact.

Nothing in these Terms or the Refund and Cancellation Policy limits a cancellation, refund, warranty, or other consumer right that cannot lawfully be waived. Contact support@financialportfoliomanager.com with a billing question or legally required refund request.

After paid access ends, dashboard access is blocked while bounded account, billing, resubscription, deletion, and non-persistent tour access remains available. Account deletion immediately revokes sessions and cancels billing, then provides a 30-day recovery window before active user data is permanently deleted, subject to the Retention and Deletion Policy.

6. Acceptable use

  • Do not break the law, violate another person’s rights, or submit information you are not authorized to manage.
  • Do not probe, disrupt, overload, reverse engineer, scrape, or bypass service security, access controls, plan limits, or provider restrictions.
  • Do not resell access, create repeated trials, use automated means beyond documented interfaces, or use the service to transmit malware or abusive content.
  • Do not misrepresent the customer’s location, intended place of use, or eligibility for the U.S.-only launch.
  • Do not use the service in violation of applicable trade sanctions or export controls, or on behalf of a person or organization prohibited from receiving the service.

7. Your data and third-party services

You retain rights in information you submit. You grant SWB Technologies the limited rights needed to host, process, secure, back up, and display that information to provide the service. You are responsible for its accuracy and legality.

If you use the service for a business or to manage another person’s personal information, you determine what information to submit and why it is processed. You are responsible for having authority to submit that information, providing any required notices, responding to requests concerning it, and using the service lawfully.

The service relies on third parties including Supabase, Vercel, Stripe, Resend, and market-data providers. Their systems may be unavailable or inaccurate. Third-party terms may also apply when you use their hosted surfaces.

8. No financial advice; disclaimers

SWB Technologies provides organizational software, not investment, tax, accounting, or legal advice. It is not a broker-dealer, investment adviser, fiduciary, custodian, or financial institution. See the Financial Information Disclaimer.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SWB TECHNOLOGIES DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not promise uninterrupted service or that third-party data will be complete, current, or error-free.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWB TECHNOLOGIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, TRADING LOSSES, OR LOSS OF DATA. SWB TECHNOLOGIES’ TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID SWB TECHNOLOGIES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where prohibited by law.

10. Suspension and termination

We may suspend or terminate access for material breach, fraud, abuse, nonpayment, security risk, or legal requirements. When practical, we will provide notice and an opportunity to cure. Terms that by their nature should survive termination, including payment obligations, ownership, disclaimers, and liability limits, will survive.

11. Governing law, changes, and contact

California law governs these Terms, without regard to conflict-of-law rules. Courts with jurisdiction over the proprietor’s principal California place of business will have exclusive jurisdiction unless applicable consumer law requires otherwise.
